FanVids Copyright Policy

FanVids, Inc. ("FanVids", "we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. This Copyright Policy outlines our procedures for addressing claims of copyright infringement on the FanVids Engagement Platform ("Platform") in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable copyright laws.

Platform Eligibility: The FanVids Platform is restricted to users 18 years of age and older. All copyright compliance obligations apply to adult users only.

2. Copyright Infringement Policy

2.3 Music Content Restrictions

Video Content may include music in the following circumstances:

Permitted Music:

  • Live performance footage of artists performing their own copyrighted works at concerts, festivals, or official events
  • Content submitted to the performing artist's official FanVids channel
  • Content submitted to authorized festival channels where the festival has proper licensing
  • Performance footage explicitly authorized by the artist or Festival Operator
  • Originally written, performed, and produced music by the user

Prohibited Music:

  • Commercial recordings or studio versions of songs
  • Cover versions of existing copyrighted songs (unless performed by original artist)
  • Unauthorized use of copyrighted background music
  • Samples from existing recordings
  • Any copyrighted music not falling within the permitted categories above

3. DMCA Notice and Takedown Procedure

3.1 Filing a DMCA Notice

If you believe that content on our Platform infringes your copyright, you may submit a DMCA takedown notice. To be effective, your notice must include:

Required Information:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the allegedly infringing material and information sufficient to locate it on our Platform
  • Your contact information (name, address, telephone number, and email address)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

3.2 Processing DMCA Notices

Upon receiving a valid DMCA notice, we will:

  • Promptly remove or disable access to the allegedly infringing content
  • Notify the user who posted the content
  • Document the takedown for our records
  • Respond to the complainant confirming the action taken

Processing Timeline: We aim to process valid DMCA notices within 24-48 hours of receipt.

4. Counter-Notification Procedure

4.1 Submitting a Counter-Notice

If you believe your content was removed in error or due to misidentification, you may submit a counter-notification containing:

Required Information:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  • Your name, address, and telephone number
  • A statement consenting to jurisdiction of the Federal District Court for your address (or Massachusetts if outside the US)
  • A statement that you will accept service of process from the complainant

4.2 Processing Counter-Notices

Upon receiving a valid counter-notice, we will:

  • Forward a copy to the original complainant
  • Restore the content within 10-14 business days unless the complainant files a court action
  • Notify you when the content is restored

5. Repeat Infringer Policy

5.1 Three-Strike System

FanVids maintains a strict policy against repeat infringement:

First Violation:

  • Content removal
  • Warning notice to user
  • Educational resources provided

Second Violation:

  • Content removal
  • Account suspension (temporary)
  • Required copyright education completion

Third Violation:

  • Permanent account termination
  • Removal of all user content
  • Ban from creating new accounts

5.2 Serious Violations

For egregious violations (such as uploading entire copyrighted works), we reserve the right to immediately terminate accounts without prior warnings.

6. Fair Use Guidelines

Fair use may permit limited use of copyrighted material for purposes such as:

  • Capturing unique interpretations or arrangements of songs
  • Documenting cultural events and artistic expression
  • Non-commercial fan appreciation and community building

Standard Fair Use Factors Still Apply:

  • Transformative nature of the fan creation
  • Limited use of original material
  • Non-commercial purpose
  • Positive impact on original work's market

Important: Artists performing their own copyrighted works at authorized venues generally have the right to permit fan recordings. Fair use analysis may not be necessary when proper authorization exists.

6.4 Best Practices

  • Use only what is necessary for your purpose
  • Transform the original work significantly
  • Provide attribution when possible
  • Consider the impact on the copyright holder's market
  • When in doubt, create original content

7. Music and Audio Content

7.1 Original Music Requirement

As stated in our Terms of Service, video content may only include music that is:

  • Originally written by the user
  • Originally performed by the user
  • Originally produced by the user

7.2 Concert and Festival Recording Policy

The Platform permits fan-recorded concert and festival footage under the following conditions:

Authorized Performance Content:

  • Live performance recordings at concerts, festivals, or official events
  • Content uploaded to the performing artist's official channel
  • Content uploaded to authorized festival channels
  • Recordings made with artist/venue/festival permission

Artist and Venue Responsibility:

  • Artists and Festival Operators are responsible for ensuring proper performance rights and venue permissions
  • Users should verify recording is permitted before capturing content
  • Venue policies and artist preferences take precedence over platform permissions

Prohibited Concert Content:

  • Recordings made without artist/venue permission
  • Content uploaded to unauthorized channels
  • Professional recording equipment usage where prohibited
  • Recordings that violate venue or artist policies

7.3 Prohibited Audio

The following are strictly prohibited:

  • Studio recordings or commercial versions of songs
  • Unauthorized cover versions of copyrighted songs
  • Copyrighted background music added to videos
  • Samples from existing studio recordings
  • Any copyrighted audio content not captured as part of authorized live performance footage

8. Automated Content Monitoring

8.1 Content ID System

FanVids uses automated systems (including AWS Rekognition) to:

  • Scan uploaded content for potential copyright violations
  • Flag content that matches known copyrighted material
  • Prevent upload of clearly infringing content
  • Detect unauthorized music usage

All automated content analysis is conducted on behalf of and as instructed by the applicable Sponsor or Festival Operator as Data Controller.

8.2 Appeal Process

If automated systems incorrectly flag your original content:

  • Submit an appeal through support@fanvids.io
  • Provide proof of ownership or authorization
  • Include detailed explanation of your rights to the content
  • We will review appeals within 3-5 business days

FanVids provides resources to help users understand:

All educational resources are available to users 18 years and older.

Safe harbor protections do not extend to users. Users remain fully responsible for ensuring their uploads comply with copyright law.

  • Terminate accounts permanently
  • Report serious violations to authorities

13. Festival and Sponsor Content

13.1 Multi-Artist Festival Content

Festival Operators must ensure:

  • Proper rights clearance for all featured artists
  • Coordination of licensing requirements across multiple artists
  • Clear authority for editorial control over user-generated content
  • Artist consent for fan content featuring their performances

13.2 Sponsor Content Rights

Sponsors and Festival Operators are responsible for:

  • Ensuring they have rights to any branding or promotional materials
  • Obtaining necessary permissions for artist likenesses
  • Managing conflicts between different rights holders
  • Providing clear guidance to users about permitted content
